LOVEbomb Terms and Conditions of Trade
Effective from: 1 September 2026
These Terms and Conditions of Trade apply to purchases of Goods and Services from LOVEbomb, including purchases made through our website and online store.
By placing an order with LOVEbomb, you agree to these Terms and Conditions.
1. Definitions
1.1 “LOVEbomb”, “we”, “us” or “our” means LOVEbomb, including its successors, assigns and authorised agents.
1.2 “You” or “Buyer” means the person, customer, business or entity purchasing Goods or Services from LOVEbomb.
1.3 “Goods” means giftware products and any other products supplied by LOVEbomb.
1.4 “Services” means any services provided by LOVEbomb, including customer support, advice or other related services.
1.5 “Price” means the amount payable for the Goods or Services, including GST where applicable.
2. Acceptance of Terms
2.1 By placing an order through our website, online store or other approved ordering channel, you agree to be bound by these Terms and Conditions.
2.2
Any amendment to these Terms and Conditions must be agreed to in writing by LOVEbomb.
2.3 If you are purchasing Goods or Services on behalf of a company, business or other entity, you confirm that you have authority to enter into the purchase on its behalf.
2.4 You are responsible for providing accurate contact, billing and delivery information.
2.5 You must notify LOVEbomb of any changes to your contact, billing or delivery details as soon as reasonably practicable.
3. Products and Product Information
3.1 We take reasonable care to ensure that product descriptions, photographs, colours, dimensions and other information displayed on our website are accurate.
3.2 Actual colours may vary slightly from images displayed on your device due to screen settings, lighting and other factors.
3.3 We reserve the right to correct errors, inaccuracies or omissions and to update product information from time to time.
3.4 All orders are subject to product availability.
3.5 If a product becomes unavailable after an order has been placed, we will contact you and may offer an alternative product or refund, as appropriate.
4. Pricing and Payment
4.1 All prices are shown in New Zealand Dollars (NZD).
4.2 Unless otherwise stated, prices displayed to consumers include GST where applicable. Wholesale or trade pricing may be displayed exclusive of GST, where clearly stated.
4.3 Prices may change without notice. A price change will not affect an order that has already been accepted by LOVEbomb.
4.4 Shipping and delivery charges may be additional to the product price and will be communicated at checkout or otherwise agreed before dispatch.
4.5 Unless otherwise agreed in writing, full payment is required before Goods are dispatched.
4.6 We accept Visa, Mastercard, debit cards and other payment methods made available through our online store.
4.7 Where a payment surcharge is applicable, it will be clearly disclosed before payment is completed and will be charged in accordance with applicable New Zealand law.
4.8 If a payment is declined, reversed or otherwise not successfully received, LOVEbomb may delay or cancel the order until payment has been received.
5. Orders and Order Acceptance
5.1 Submitting an order through our website constitutes an offer by you to purchase the selected Goods.
5.2 An automated order confirmation confirms that we have received your order. It does not necessarily mean that the order has been accepted.
5.3 An order is accepted when LOVEbomb confirms acceptance, processes the order or dispatches the Goods, whichever occurs first.
5.4 We reserve the right to decline or cancel an order where:
- Goods are unavailable;
- There has been an obvious pricing or product description error;
- Payment has not been successfully received;
- We reasonably suspect fraudulent or unauthorised activity; or
- We are otherwise unable to fulfil the order.
5.5 If we cancel an order after payment has been received, we will refund the amount paid for the cancelled Goods.
6. Shipping and Delivery
6.1 Goods will be delivered to the address provided when placing the order.
6.2 Delivery fees may vary depending on the delivery address, region, order size, weight and delivery method.
6.3 You are responsible for ensuring that the delivery address is accurate and complete.
6.4 You should ensure that someone is available to accept delivery or that a suitable safe place is available where the courier can leave the Goods.
6.5 Delivery timeframes are estimates only. LOVEbomb is not responsible for delays caused by couriers, freight providers, weather, public holidays, supply-chain disruptions or other circumstances outside our reasonable control.
6.6 For wholesale or bulk orders, slight discrepancies in quantity of up to 10% may occur where Goods are supplied in bulk or production quantities. Where this occurs, the invoice or order quantity may be adjusted accordingly.
7. Risk and Title
7.1 For consumer purchases, risk in the Goods passes in accordance with applicable New Zealand law.
7.2 For business or wholesale purchases, risk in the Goods passes to the Buyer upon delivery, unless otherwise agreed in writing.
7.3 Ownership of Goods remains with LOVEbomb until full payment has been received.
7.4 Where ownership has not yet transferred, the Buyer must keep the Goods identifiable and must not sell, transfer, pledge or use the Goods as security, except where otherwise agreed in writing.
8. Returns, Faults and Damaged Goods
8.1 We want you to be happy with your LOVEbomb purchase.
8.2 If your order arrives damaged, incorrect or faulty, please contact us as soon as reasonably practicable at hello@lovebomb.co.nz.
8.3 Where possible, please provide your order number, photographs and a description of the issue so we can assess the matter promptly.
8.4 No Goods should be returned without prior approval from LOVEbomb.
8.5 Where a return is approved, we will provide instructions for returning the Goods.
8.6 Nothing in these Terms and Conditions excludes, restricts or limits any rights or remedies you may have under the New Zealand Consumer Guarantees Act 1993 or any other applicable law.
8.7 For consumers, where Goods do not meet the guarantees required by New Zealand law, LOVEbomb will provide the remedy required by law, which may include repair, replacement or refund depending on the circumstances.
9. LOVEbomb One-Year Manufacturing Defect Guarantee
9.1 LOVEbomb stands behind the quality of the LOVEbomb range.
9.2 In addition to any rights available under New Zealand consumer law, LOVEbomb offers a one-year guarantee against manufacturing defects on products within the LOVEbomb range.
9.3 The one-year period begins from the original date of purchase.
9.4 This guarantee applies to genuine manufacturing defects occurring during normal and reasonable use of the product.
9.5 The guarantee does not cover damage resulting from:
- Normal wear and tear;
- Accidental damage;
- Misuse, abuse or neglect;
- Incorrect use;
- Incorrect care, cleaning or storage;
- Unauthorised alterations or repairs; or
- Damage unrelated to a manufacturing defect.
9.6 To make a claim, please contact hello@lovebomb.co.nz and provide your proof of purchase, order number, a description of the issue and photographs where appropriate.
9.7 LOVEbomb will assess the product and determine whether the issue is covered by the guarantee.
9.8 Where a manufacturing defect is confirmed, LOVEbomb may, at its discretion and subject to applicable law, repair or replace the affected product or provide another appropriate remedy.
9.9 This one-year manufacturing defect guarantee is additional to, and does not replace, exclude or limit, any rights you may have under the New Zealand Consumer Guarantees Act 1993.
10. Manufacturer's Warranty
10.1 Where applicable, LOVEbomb will assist customers with manufacturer warranty claims.
10.2Nothing in these Terms and Conditions limits any rights or remedies that cannot legally be excluded under New Zealand law.
11. Order Cancellations
11.1 If you wish to cancel an order, please contact us as soon as possible at hello@lovebomb.co.nz.
11.2 We will make reasonable efforts to accommodate cancellation requests received before an order has been processed or dispatched.
11.3 Once an order has been processed or dispatched, cancellation may no longer be possible and the applicable returns process will apply.
11.4 For wholesale and custom orders, cancellation may be subject to additional terms agreed at the time of order.
11.5 Nothing in this section affects any cancellation, refund or other rights you may have under applicable New Zealand law.
12. Wholesale and Business Purchases
12.1 Wholesale and trade purchases may be subject to separate wholesale pricing, minimum order quantities, payment terms and delivery requirements.
12.2 Wholesale pricing is confidential and available only to approved wholesale customers.
12.3 Unless otherwise agreed in writing, wholesale orders must be paid in full before dispatch.
12.4 Wholesale customers are responsible for inspecting Goods upon delivery and notifying LOVEbomb promptly of any discrepancies, damage or defects.
12.5 Where both parties are in trade, the parties may agree in writing that certain provisions of the Consumer Guarantees Act 1993 do not apply to a particular transaction, where permitted by New Zealand law.
12.6 Any such agreement will only apply where the requirements of applicable New Zealand law have been satisfied.
13. Intellectual Property
13.1 All LOVEbomb branding, trademarks, logos, product designs, photographs, graphics, product descriptions, marketing materials and other intellectual property remain the property of LOVEbomb or the relevant rights holder.
13.2 You must not copy, reproduce, modify, distribute or commercially use LOVEbomb intellectual property without our prior written permission.
13.3 Approved wholesale customers may use authorised LOVEbomb marketing materials solely for the purpose of promoting and selling LOVEbomb products.
14. Website Use
14.1 You agree to use our website lawfully and responsibly.
14.2 You must not interfere with the operation or security of our website or attempt to gain unauthorised access to our systems.
14.3 We reserve the right to suspend or restrict access to our website where reasonably necessary to protect our business, customers or systems.
15. Privacy
15.1 We collect and use personal information in accordance with applicable New Zealand privacy laws and our Privacy Policy.
15.2 Information provided when placing an order may be used to process your purchase, arrange delivery, communicate with you about your order and provide customer support.
16. Liability
16.1 Nothing in these Terms and Conditions excludes, restricts or modifies any right, remedy, guarantee, warranty, liability or obligation that cannot legally be excluded or limited under New Zealand law.
16.2 To the maximum extent permitted by law, LOVEbomb is not liable for indirect, incidental or consequential loss, including loss of income, revenue, business or profits.
16.3 For business-to-business transactions, and to the extent permitted by law, LOVEbomb's total liability arising from a particular order will not exceed the amount paid for the Goods giving rise to the claim.
16.4 This limitation does not apply to any liability that cannot legally be limited or excluded.
17. Circumstances Beyond Our Control
17.1 LOVEbomb will not be responsible for delays or failure to perform our obligations where this results from circumstances beyond our reasonable control.
17.2 This may include natural disasters, severe weather, transport or courier delays, supply-chain disruptions, industrial action, government restrictions, power or internet outages, or other unforeseen circumstances.
18. Changes to These Terms
18.1 LOVEbomb may update these Terms and Conditions from time to time.
18.2 The Terms and Conditions applying to your purchase will generally be those in effect at the time your order is accepted.
19. Governing Law
19.1 These Terms and Conditions are governed by the laws of New Zealand.
19.2 Any dispute arising in connection with these Terms and Conditions will be dealt with in accordance with applicable New Zealand law.
